N.Govindarajan vs N.Leelavathy and others

Head note

Original Side Rules - Order XXXVI Rule 1, Letters Patent - Clause 15, Indian Succession Act 1925 - Sections 63 & 63(c), Indian Evidence Act - Section 68 -Execution of Will is a solemn act of executant who must own up recitals in instrument - there must be clear evidence that he puts his signature in a document after knowing fully its contents.

Mere fact that signature of a person is proved on a document does not necessarily mean that person who has signed the document has done so after understanding contents of document.

Unnatural disposition excluding the wife and daughters is yet another suspicious circumstance.
