Court auction purchase was during the pendency of the plaintiff's suit, the sale is hit by lispendens under Section 52 of the Transfer of Property Act and it is void.

"The Plaintiff filed the present suit on 26.10.1972 and it was disposed of on 20.04.1978. The Court auction sale was on 25.02.1976. Learned counsel for the appellant contended that as the Court auction purchase was during the pendency of the plaintiff's suit, the sale is hit by lispendens under Section 52 of the Transfer of Property Act and it is void and no title can pass in favour of the defendant
