Under Section 97 of CPC - matters, which are concluded by preliminary decree cannot be re-agitated in an appeal against the final decree.

wherein the Hon'ble Supreme Court has held that the matters, which are concluded by preliminary decree cannot be re-agitated in an appeal against the final decree. Section 97 of CPC preclude a party to the preliminary decree to dispute its correctness in any appeal, which is preferred against the final decree
