when no appeal has been filed as against the preliminary decree, the party to the preliminary decree cannot challenge the correctness of the preliminary decree in an appeal filed against the final decree

 has reiterated the position that when no appeal has been filed as against the preliminary decree, the party to the preliminary decree cannot challenge the correctness of the preliminary decree in an appeal filed against the final decree. The position is evident from Section 97 of C.P.C
