Union of India and Anr. v. M. V. Engineering Company

Arbitration and Conciliation Act (26 of 1996), S.34, S.36 - (as Amended By 2015 Amendment
Act ) Arbitral award - Execution - JD seeking execution proceedings to be kept in abeyance
or stayed till application for setting aside award is decided - Filing of application to set aside
arbitral award itself does not render award unenforceable unless appropriate orders are passed
by Court granting stay of operation of award - Unamended S.36 of Act does not provide
automatic stay of award pending application u/S.34 - Amended S.36 being clarificatory in
nature merely restates position of original S.36 of Act.
