Compromise Decree under Order 23 Rule 3 of Civil Procedure Code can only be set aside in separate suit or proceedings on the ground that the consent has been obtained by fraud or coercion

Gosto Behari Pramanik v. Smt.Malati Sen and others AIR 1985 CALCUTTA 379 at page 380 wherein it is held that "a Compromise Decree under Order 23 Rule 3 of Civil Procedure Code can only be set aside in separate suit or proceedings on the ground that the consent has been obtained by fraud or coercion and such consent or Compromise Decree resulted in serious and substantial justice".
