If the possession of the impugned land of the petitioner had not been taken over by the Government, the Principal Act cannot be given effect to

Madras High Court Writ Petition No.6312 of 2000 dated 04.08.2005 “It is clear from the above that as per Section 3(1(a), the repeal of the Principal Act shall not affect the vacant land, the possession of which has been taken over by the State Government. In other words, if the possession of the land in question has not been taken over by the Government, the https://www.mhc.tn.gov.in/judis W.P.No.34209 of 2019 principal Act could not be given effect to. Therefore, suffice to say that if the possession of the impugned land of the petitioner had not been taken over by the Government, the Principal Act cannot be given effect to. The writ petition is disposed of accordingly.”
