sale of plot of land simpliciter, complaint is not covered under the Consumer Protection Act - would be governed under the provisions of Specific Relief Act by filing a suit before a competent Civil Court

   It is well settled that a complaint is not maintainable under the Act for sale of land simpliciter.  In a decision reported in 2015 (2) CPR 195 (Yelchuri Subrahmanyam & Ors. - vs. Buddi Sankara Babu & Ors.), the Hon'ble National Consumer Commission relying upon a decision of the Hon'ble Supreme Court in Civil Appeal No.331/2007 dated 26.09.2013 (Ganeshlal - vs. - Shyam) has observed that where there is a sale of plot of land simpliciter, complaint is not covered under the Consumer Protection Act
