After the purchase of the property in the Court, without filing an application under Order 21, Rule 95, the Court auction purchaser filed the suit for delivery of possession and in that circumstances, the Hon'ble Division Bench of this Court has held that the suit for recovery of possession by the Court auction purchaser, without getting possession of the property by filing an application under Order 21, Rule 95 is not maintainable.
